By using the application, the user agrees to the defined terms and conditions in the Data Management Guide, and accepts further management of their data, as described below.

 

A.     Definitions

 

a.     User: any particular person that can be identified directly or indirectly via personal data;

b.     Personal data: data that can be applied to a user; especially the name of said user, their identifying attribute, or one or more pieces of information relating to the user's physical, physiological, mental, economic, cultural or social characteristics, and also the conclusion drawn from said data;

c.     Agreement: the voluntary and definitive declaration of the user's intent, which is founded on sufficient information, and with which the user gives its unambiguous accord to the full or partial management of their personal data;

d.     Disagreement: the user's objection to the management of their personal data, or their request for discontinuing the management of said data, or for the complete deletion of said data;

e.     Data Manager / Service Provider: a particular or legal person, or organization that does not qualify as legal person; who or which determines the aim of the management of data independently or with others; decides and executes in the means of data management (including the device used), or has these means executed by their assigned data processor;

f.      Data Management: any operation or collective of operations executed on the data; such as collection, recording, storing, enquiring, forwarding, publishing, synchronizing, connecting, classification, deletion, shredding of data, and also the prevention of further use of the data, making a photographic, an audio or a video recording, or recording physical characteristics for the identification of the user (e.g.: finger or hand-print, DNA-sample, iris-scan);

g.     Data Processing: the performing of technical tasks relating to the management of data, independent from the means of the used operation and instrument, and also the place of application, supposing that the technical task has been performed on the data;

h.     Data Processor: a particular or legal person; or organization that does not qualify as legal person; who or which processes data according to the contract concluded with the data manager--supposing a lawful conclusion of the contract;

i.      Forwarding of Data: providing access to the data for a defined third party;

j.      Publishing of Data: providing access to the date for anyone;

k.     Deletion of Data: the rendering data unrecognizable to such a degree, that their reconstruction is not possible;

l.      Classification of Data: assigning an identifying signal to data for final or temporary restriction on access to it;

m.   Shredding of Data: the complete physical shredding of the data carrier that carries the data in question;

n.     Third party: a particular or legal person; or organization that does not qualify as legal person; who or which is not equivalent with the user, the data manager or the data processer;

o.     Data security incident: the unlawful management or processing of personal data, thus unauthorized accessing, changing, forwarding, publishing, deletion, or shredding; or accidental deletion and shredding of said data;

C.     The Types of Personal Data Required, the Object, Legal Title and Time Period of Personal Data Management

The data management by the Service Provider takes place in accordance with the following Hungarian law: "2011. évi CXII. Törvény 5. § (1) bekezdés a)" which states that the user voluntarily provides their personal data in services related to trading electronically, related to informational society as discussed in the "2001. évi CVIII." Hungarian law.

The Service Provider does not check verify the validation of personal data. Solely the provider of personal data--i.e. User--is responsible for the accuracy of said data. Any instance of providing the e-mail address of a User, the provider takes responsibility, that they and only they will be the users of the service from that e-mail address. Any responsibility concerning signing in from the provided e-mail address falls upon the provider of the e-mail address.

 

C.1.  The Technical Details of the Users of this Application

During the use of the application, the Service Provider records the IP address of the user, the time period of use (including start- and end-time), and also the type of browser and operating system used--for technical and also statistical reasons to research user behavior. These data is saved periodically and automatically by the system in place. The system does not combine these data with the ones provided at registration or use. Only the Service Provider has access to these data that is being stored on the Google Firebase server. C.2.  Registration in the app

At the registration, we distinguish users into two groups: Nail Technician users and Client users. When registering, the Nail Technician user is asked to provide the following details:

 

·       First Name

·       Last Name

·       E-mail Address

·       Password

·       Phone Number

·       Country

·       City

 

When registering, the Client user is asked to provide the following details:

 

·       First Name

·       Last Name

·       Code of chosen Nail Technician

·       E-mail Address

·       Password

·       Phone Number

 

The Service Provider uses these data for the identification of Users and to conduct statistical analysis. The e-mail address is also needed for the confirmation e-mail to be sent, and also to establish communication in the future, if needed. The names and phone numbers are shared between two consenting users, who wish to communicate.

The password for signing-in is provided by the User. The passwords are stored in an encrypted form on the server of Firebase, and cannot be decrypted. Therefore, neither the Service Provider, nor anyone else could access the password itself. After signing-out of the app, a new password can be requested with providing the registered e-mail address.

For modification or deletion of personal data, please contact the Service Provider.

The User can request the deletion of certain personal details via [email protected]. In case of request for deletion of said data, it will take place in the following 5 workdays.

 

C.3.  Newsletter, Text message

Aside from registration, the Nail Technician users have the opportunity to request electronic newsletter. Following the subscription to the newsletter, e-mails will be sent on a weekly basis. At the bottom of every e-mail, there is an 'Unsubscribe' button, which, if clicked, the user unsubscribes from the newsletter. Users can unsubscribe via mail being sent to the postal address provided at Section B. Unsubscribing from the newsletter does not mean the automatic deletion of personal data--the deletion needs to be requested explicitly. The user accepts that the Service Provider is allowed to notify the user about important changes, and events.

 

C.3.1 Date storage of newsletter subscribers:

The date of the newsletter subscribers are stored in the ListaMester mailing system. The system is operated by the following service provider as a date processor:

C.4.  Contact

In case of enquiry, please contact us at the contact details provided at Section B, where the Service Provider can be contacted.

In case of any problematic issue or enquiry, the Service Provider deletes every incoming mail containing the name and e-mail address of the sender--at most--90 days after its arrival to the premises.

 

D.     Data Processing

Primarily, the Service Provider and its colleagues are authorized to process, but not publish or provide access to a third party.

The users of the application can consensually contact each other, in which case they automatically share their personal data with one another.

E.     The means of storing personal data and the security of data management

The Service Provider manages personal data primarily at its premises.

The Service Provider stores the personal data on a secured server.

The Service Provider ensures the security of data management through such technical, organizational and constitutional means that provide a sufficiently high level of security.

The computer and IT system of the Service Provider are also secured against cyber-fraud, -spying, -sabotage, -vandalism, -attacks, computer viruses, and physical dangers like fire or flooding, or other attacks that would result in service denial. The Service Provider ensures both server-level and app-level security measures.

E-mails forwarded through the internet are volatile to network-level threats that would result in misconduct, denial of contract, undesired disclosure or modification of data. The Service Provider does everything in its power to prevent such threats, and monitors the systems in order to record every safety measure, and later provide evidence in every case. The monitoring of said system also enables to observe the efficiency of all safety precautions.

 

F.      Users' Rights, and Possibilities for Legal Remedy

F.1.  The Right to be Informed

The User has the right to request to be informed about the User's personal data managed by the Service Provider via [email protected] or via post.

The Service Provider informs the User about the User's personal data managed and processed by the Service Provider or a Data Processer assigned by the Service Provider, and also the source, the aim, the legal basis, the time period of said data, but also the name, address, and relations of the Data Processer to the Data Management. Furthermore, the circumstances, the effect, and the safety precautions made for the prevention of data security incident, and also the legal basis and addressee of forwarding personal data. The Service Provider informs the User about the requested information in 30 days.

The User can contact the responsible employee of the Service Provider to request information about data management, via the means defined below: Email, phone, or written letter. Contact information can be found in section B.

 

F.2.  The User has the right to request the deletion, correction or classification of their personal data. The user has the right of data portability.

The Service Provider keeps a register of the data security incident which includes the types of personal data, the list and number of those impacted, the time, circumstances and effects of the data security incident, and also the security measures made for its prevention, and other prescribed data required by law. The User can request the deletion, correction or classification and export of their personal data.

The User has the right to request the correction or deletion of their incorrect personal data via the contact details provided below. The Service Provider has 5 workdays from the arrival of request to delete the personal data, rendering the data irreparable. The deletion does not apply to the data management required by law; the Service Provider stores them for the time required by law.

The User can also request the classification of their personal data. The Service Provider classifies the personal data, if the User so request, or if the information at hand can suggest that deletion of said data would violate the User's personal legal interest. Therefore, the classified data can solely be managed until the aim of data management is valid, which excludes the deletion of personal data.

In case of modification, classification or deletion, everyone involved in the management of the personal information in question--including the User--needs to be notified about the modification, classification or deletion of said data. The notification can be omitted, if it does not violate the rightful personal interest of the User with regards to the aim of data management.

If the Service Provider does not fulfill the User's request for the modification, classification or deletion of personal data, in the 30 days following the arrival of the request, the Service Provider informs the User about the factual and legal reasons for the denial of the modification, classification or deletion.

 

F.3.  The User can object to the management of their personal data.

The Service Provider examines the objection in the shortest time span possible, but in 15 days at most. Then, the Service Provider decides on the validity of said objection, and then informs the User about this decision.

The User can practice their rights on through the contact details provided at Section 2.

 

F.4.  According to the Hungarian statute book "Polgári Törvénykönyv" (as described in the law "2013 évi V. törvény") the User can do the following: either…

i.       …contact the Hungarian National Authority for Data Protection and Freedom of Information (Hungary, 1125, Budapest, Szilágyi Erzsébet fasor 22/C; www.naih.hu), or;

ii.       …practice their right in front of law court.

In case the User provided the data of a third party, or caused harm with the use of the application in any way, the Service Provider has the right to validate compensation from the User. The Service Provider provides all the possible help for the executive authorities to establish the User who validated rights.

 

F.5.  Responsibility of Parties

By downloading and using the application, the User accepts that the Service Provider does not guarantee the application's untroubled and continuous operation, and the Service Provider is not responsible for any harm caused by the inadequate operation of the application. The User cannot request compensation from the Service Provider for the inadequate operation of the application and has no legal founding to do so. The Service Provider is not responsible for the conduct of Users. The Service Provider is not responsible for any financial harm caused by faulty operation or misunderstand in case the User uses the application for business purposes. The User accepts that the application requires continuous internet connection for untroubled operation.


 

G.     Other Data Managements

The User notes that the Service Provider can inform, and provide all data for the court, prosecutor and investigating authorities. (Hungarian law: a büntetőeljárásról szóló 1998. évi XIX. törvény 71. §). In case the investigating authorities stated their data request and exact goals with it the Service Provider provides only the required data for the authorities.

The Service Provider keeps the right to change this Data Management Guide at any times after notifying the User. After the modification the User accepts the new Data Management Guide by keep using the application.

Issues not specified in the present document fall under the operation of the following Hungarian laws: "2013. évi V. tv., a 45/2014. (II. 26.) Korm. rendelet)" and "2001. évi CVIII. tv." which discusses the services related to trading electronically, and those related to informational society.

By downloading and using the application the User accepts the General Terms and Condition and Data Handling of Mystic Nails Hungary Kft.

The application of Mystic Nails Hungary Kft. Falls under the operation of Hungarian law, which are accepted by the User.

Mystic Nails Hungary Kft. prefers to settle cases primarily outside of court, but in case a legal procedure is needed, it is only willing to participate in such procedures exclusively at the Judiciary of Szeged.

Copyright

The entirety of the application, its graphical elements, texts and technical procedures and elements of the Service are under copyright and other relevant rights that are protective of intellectual property and trademark. The Service Provider is entitled to access and manage all of the displayed content during the providing of services through the use of the application; i.e. all of the displayed authorial work or intellectual property (including every graphical element, and other materials, the arrangement of the platform of the application, its design, the software and other procedures used, the idea, and the realization, as well).

Preliminary written permission is needed from the Service Provider for the copying any element or content of the application to a physical data carrier or printing of these for personal use. Preliminary written permission is needed for any use of this data, e.g. storing it in a database, forwarding it, publishing it or making it downloadable, or selling it.

Apart from the rights explicitly described in the present Terms and Conditions document, the right to register to and use the application, the User has no right to use or exploit the commercial name and trademark. Preliminary written permission is needed from the Service Provider for anything that goes beyond the necessary duplication, copying, or display of the application during personal use.

The Service Provider has the exclusive rights to its services, all element of its services, especially to the name “Nails On Time.” Any other action is prohibited which aims to list, to systematize, to archive or hack the database or its source code, except if the Service Provider provides an explicit permission for it.

Any action is prohibited that aims to modify, copy, or overwrite the data stored in the database of the Service Provider with the evasion of the search engine, or any action that aims to modify the platform provided by the Service Provider, if the Service Provider provides an explicit permission for it.

By using the Service, the User accepts that the Service Provider is entitled to use the personal data provided by the User during the use of the Service, within the terms of the Terms and Conditions document, and to use this data anytime, anywhere, without any restriction or without having to pay any extra charges.
